HOA ORDER FORM 5 – NOTICE OF REDIRECTED LEASE PAYMENTS

(Used To Notify a Tenant of Utah Property That Its Lease Payments Must Be Paid to an Association Until Unpaid Assessments Have Been Satisfied)

Reminder: Before redirecting lease payments you are required to give the owner a 15 Day Warning Notice. If you have not yet done so, complete HOA Order Form 4 instead of this form to send the required warning.

Reminder: Your association’s declaration, bylaws, or rules must authorize your association to redirect lease payments.

1. IDENTIFY THE ASSOCIATION THAT IS REQUESTING THIS NOTICE (I.E. YOUR ASSOCIATION):

IDENTIFY THE PROPERTY THAT IS DELINQUENT IN THE PAYMENT OF ASSESSMENTS.

Be specific enough to distinguish the property from all other properties. [Examples: Lot 3 Springhill Subdivision; or Greystone Condominiums, Unit C; or 1291 Harbor Drive, Ogden, Utah].

IDENTIFY EACH OWNER OF THE DELINQUENT PROPERTY WHOSE RIGHTS ARE BEING TERMINATED:

SIGNATURE & TERMS: The association on whose behalf this form is submitted (“Association”) hereby appoints Lien Utah LLC as its agent for the limited purpose of preparing, recording, and serving the notice requested herein. Association warrants that it is authorized by its declaration, bylaws, and/or rules to redirect lease payments, that it has fulfilled all actions necessary to redirect lease payments, and that it is owed overdue assessments on the Property. Association covenants to indemnify, defend (with counsel chosen by Lien Utah LLC), and hold harmless Lien Utah LLC, and its agents, successors and assigns, against any and all claims brought against Lien Utah LLC arising from the notice requested herein. Association understands and agrees that Association’s sole and exclusive remedy against Lien Utah, LLC for any damages, including direct, indirect, or consequential damages, arising from the notice requested herein is limited to a refund of the amount paid to Lien Utah LLC for the services requested by Association in this order form. Association warrants that the information provided herein is true and accurate. If Lien Utah LLC is asked to provide trial or deposition testimony, sworn declarations, or other evidence establishing that the notice requested was served, it will be paid $40 per hour for the time incurred. The undersigned warrants that he/she is duly authorized to order this notice on behalf of Association and does so with its authorization. Association agrees to promptly pay for the requested services upon receipt of an invoice. If payment is not made within 21 days of the invoice date, Association will pay interest at the rate of 2% per month from the invoice date on all amounts owed. Association will pay Lien Utah LLC’s attorneys’ fees and costs incurred in enforcing these terms.    Prices assume one property owned by persons residing at one address.  An additional $10 will be charged for each additional property included in the same notice and for each additional owner address to which the notice is served.  Prices assume customer will provide complete and accurate information.  If not, an additional charge will be assessed commensurate with the above charges for additional properties/owners and for any additional time needed to obtain the missing information.
